General Information

All items on this website are handmade, not mass produced. The descriptions of items on the website are a guide only, although we do try to be as accurate as we possibly can. In some cases the photograph may not be of the exact item that is for sale but similar in style colour and size. When this is the case we specify it clearly in the description. Due to camera, browser and monitor settings the colours of the actual stones may be slightly different to those in the photographs.

All measurements (including ring sizes) are approximate.

Payment

Payment can be made by credit or debit card safely and securely via Paypal. You do not have to have a Paypal account to use this facility. Poppy Dandiya trades online under the name ‘Phool Chand Zilversmid’ any communication from Paypal will use this name.

Once payment is received we aim to despatch your jewellery within 5 working days. You will receive an email notifying you of despatch and estimated delivery time. If you have a special requirement regarding delivery date, eg birthday or anniversary, please email us and we will do everything we can to meet your deadline.

Packaging

Your jewellery/gift will be send to you in an attractive ‘Poppy Dandiya’ box. Please rest assured that we always package our items securely and safely.

Postage & Delivery

We regret that at the present time we are unable to ship internationally.

UK customers:

All orders will be sent by Royal Mail special delivery free of charge. Packages will need to be signed for on delivery. If no-one is available to give a signature a card will be left giving details of how to re-arrange delivery, or collect from your local sorting office.

Returns

We want you to be completely happy with your purchase. Return any item within 7 working days to get a full refund, no questions asked. Unless the item is faulty we do not pay return postage costs. Please use Royal Mail Special Delivery for returns, we cannot be held responsible for items that are lost in transit. Goods must be in their original packaging and in an unworn condition suitable for resale.

We will not refund or exchange goods that have been worn, or show obvious signs of abuse. In this instance the goods will be returned to the customer at their own cost. In the unlikely event that goods you receive are faulty we shall refund postage costs to you. You must inform us by email please mail@poppydandiya.com (not telephone) before returning any goods.

 

 

 

 

 

 


Further Terms and Conditions

1. Definitions

a) "Poppy Dandiya”and “Phool Chand Zilversmid” is also referred to as "we" or "us" in these terms and conditions.
b) "Force Majeure" means any clause affecting the performance by Poppy Dandiya of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.
c) "Working days" means Monday to Friday, excluding Bank or other Public holidays.

 

2. Orders

a) All contracts of sale made by Poppy Dandiya shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the party ("the Customer") with whom Poppy Dandiya is dealing. Cancellation of orders by consumers can only be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000.
b) All orders are subject to acceptance and to availability of the goods ordered. Poppy Dandiya is entitled to refuse any order placed by you.
c) You undertake that all details you provide to us for the purpose of purchasing goods or services offered on our web site are correct.

 

3. Prices

a) All prices are inclusive of VAT at the current rates and are correct at the time of entering information.
b) Poppy Dandiya reserves the right to change prices without prior notice.

 

4. Delivery, title and risk

a) Any time or date stated for delivery is an estimate only. Poppy Dandiya makes every effort to despatch goods on time, but does not accept liability for failure to deliver within the stated time.
b) Poppy Dandiya does not accept liability for damage to deliveries unless the Customer notifies Poppy Dandiya of the damage in writing (email) within 7 days of receipt of the delivery.
c) The customer has to accept the goods when they are ready for delivery.
d) Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risk of loss, breakage and all damage and all other risks shall pass to the Customer.

 

5. Warranties and Returns

a) Poppy Dandiya is committed to providing our customers with the highest quality products and service. However, on rare occasions, products may be found to be faulty or defective. In such cases, we offer the returns facilities described below.
b) We warrant our product against defects in material and workmanship under ordinary consumer use (unless otherwise specified) for a period of one year from the date of the original retail sale. During this period if a defect arises, we will, at our option, to the extent permissible by law, either 1) repair the defect or 2) replace the product or 3) refund to you all or part of the purchase price. All replaced or refunded products, or parts, become our property.
c) Stringing, such as incorporated in the making of some necklaces and bracelets, is guaranteed for not longer than a period of 6 months from the date of retail sale.
d) Subject to the right of consumers to return goods for refund under The Consumer Protection (Distance Selling) Regulations 2000. Poppy Dandiya does not sell products on a trial basis. Customers are strongly advised to check suitability and specifications of products before ordering.
e) In the event that Poppy Dandiya, at its discretion (unless the Consumer Protection (Distance Selling) Regulations apply), agrees to accept the return for credit of unwanted products, the goods must be returned within the guidelines of the Returns Policy.

 

6. Poppy Dandiya’s liability

a) Poppy Dandiya shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, including (but not restricted to) loss of business or profits, loss of goodwill, damage to trading relationships, emotional or psychological trauma or other financial loss (“Financial loss” in this sense does not refer to the price you have paid for the goods, which we may be liable to refund to you, in whole or in part, if the goods are faulty or do not comply with their description). Poppy Dandiya’s liability in respect of all other losses shall be limited to the invoiced amount of the relevant order, provided it has been paid.

 

7. Force Majeure

Where, in spite of its reasonable efforts, Poppy Dandiya is unable to perform an obligation due to force majeure, it shall not be deemed to be in breach of its contract with the Customer.

 

8. The consumer protection (distance selling) regulations 2000

a) Contracts for the purchase of goods by a Customer not acting in the course of a business through the Poppy Dandiya website, are with the exception of certain excepted contracts, subject to The Consumer Protection (Distance Selling) Regulations 2000 (“the Regulations”).
b) If the Regulations apply, Customers may cancel goods purchased from Poppy Dandiya by sending a written notice of cancellation by email to mail@poppydandya.com.
c) The notice of cancellation must be delivered within 7 working days of the date of delivery of the goods.
d) The Customer will be responsible for the cost of returning the goods if he or she exercises this right of cancellation under the Regulations.
e) The Customer is under a duty to retain possession of the goods whilst awaiting return to Poppy Dandiya and to take reasonable care of them during this period. The Customer will be liable for any loss of or damage to the goods if he or she fails to comply with this obligation.

 

9. Errors and omissions

a) Poppy Dandiya makes every effort to ensure that all prices and descriptions quoted on its website are correct and accurate. However, it is inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, Poppy Dandiya will be entitled to rescind the contract, notwithstanding that it has already accepted the Customer’s order and/or received payment from the Customer. Poppy Dandiya’s liability in that event will be limited to the return of any money the Customer has paid in respect of the order.

 

10. General

a) Nothing in these terms and conditions affects your statutory rights as a consumer.
b) Poppy Dandiya reserves the right to change or amend these terms and conditions at any time and without prior notice.
